Are construction liens assignable?
Yes, construction liens are assignable, except liens of laborers. Florida Statutes Section 713.19 provides that a lien or prospective lien, except that of a laborer, may be assigned by the lienor at any time before its discharge. The statute states that an assignment of a lien may be recorded in the county clerk’s office. This implies that an assignment of lien need not be recorded in order to be enforceable; but the better practice would be to record the assignment to avoid arguments of unenforceability due to prejudice from lack of notice of the assignment.
